Primero. REVOCAR la Sentencia proferida por el Juzgado
Segundo. Penal Municipal de Santa Rosa de Cabal, Risaralda, el trece (13) de diciembre de 2002 en la que se decidió no tutelar los derechos invocados por el accionante, Pastor de Jesús Toro Osorio.
Segundo. En su lugar, CONCEDER la tutela interpuesta por Pastor de Jesús Toro Osorio para la protección de su derecho a la vida en conexidad con el derecho a la salud. En consecuencia, ORDENAR a Asmet Salud ARS que en el término de cuarenta y ocho (48) horas contados a partir de la notificación de la presente sentencia, adopte las decisiones necesarias para asegurar que se proporcione al accionante el oxígeno domiciliario solicitado antes del vencimiento de dicho término.
Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
