DECISION
En mérito de las consideraciones antecedentes, la Sala Cuarta de Revisión de Tutelas de la Corte Constitucional,
RESULEVE:
Primero. REVOCAR la sentencia proferida por la Sala Penal del Tribunal Superior de este Distrito Judicial el 17 de septiembre de 1996, y la dictada por la Sala de Casación Penal de la Corte Suprema de Justicia el 29 de octubre de 1996. En su lugar, proteger el derecho al debido proceso del señor Alvaro Vanegas Bernal.
Segundo. DECLARAR LA NULIDAD de lo actuado dentro del proceso disciplinario seguido al actor, a partir de la ejecutoria de la providencia dictada por el Consejo Seccional de la Judicatura del Meta, y ordenar inaplicar, para todos los efectos, el numeral 4o. de la citada sentencia.
Tercero. COMUNICAR la presente providencia a la Sala Penal del Tribunal Superior de este Distrito Judicial, para los efectos contemplados en el artículo 36 del Decreto 2591 de 1991.
