El demandante alega que la Empresa de Acueducto y Alcantarillado de Bogotá EAAB-ESP vulneró sus derechos fundamentales a la igualdad, a la vivienda digna y al agua, al no realizar la instalación y conexión del servicio de acueducto, agua y alcantarillado a su vivienda, argumentando la inexistencia de redes oficiales y por tanto, no falta de la infraestructura necesaria para la prestación del servicio.
La demandada además adujo que la vivienda para la cual se solicitó el servicio se encontraba con afectación de riesgo geotécnico, por ubicarse en una zona de amenaza por remoción alta.
En sede de revisión la Sala comprobó que se superó la probable vulneración alegada y con base en ello, decidió declarar la CARENCIA ACTUAL DE OBJETO POR HECHO SUPERADO.

- TERCERO. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
