- Primero. CONFIRMAR, pero por las razones expuestas en la parte motiva de esta providencia, el fallo proferido el 26 de mayo de 2000 por la SALA CIVIL DEL TRIBUNAL SUPERIOR DE BOGOTA, que revocó la decisión del a-quo en el proceso de la referencia, consignada en sentencia de fecha 2 de mayo de 2000 y en su lugar denegó la acción de tutela impetrada por el señor TITO JULIO BAQUERO MEDINA contra la Corporación de Ahorro y Vivienda DAVIVIENDA, hoy BANCO DAVIVIENDA.
- Segundo. LIBRAR por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
