- Primero. REVOCAR en todas sus partes la Sentencia proferida por el Juzgado Once Laboral del Circuito de Santa Fe de Bogotá el 27 de octubre de 1994.
- Segundo. CONCEDER la tutela impetrada por FANNY AURORA NIETO DE MARTINEZ y, en consecuencia, ORDENAR al Subdirector de Prestaciones Económicas y al Director de la Caja Nacional de Previsión Social, en su caso, que, si todavía no lo han hecho, resuelvan, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, los recursos interpuestos por la accionante desde el 21 de diciembre de 1993 contra la Resolución Nº 41209 de noviembre 18 del mismo año.
- Tercero. REMITASE copia de esta providencia al Procurador General de la Nación, para lo de su cargo.
- Cuarto. LIBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
