Primero. REVOCAR la sentencia proferida por la Corte Suprema de Justicia, Sala de Casación Laboral, el 4 de octubre de 2001 y, en su lugar CONCEDER la tutela impetrada por el ciudadano Diego Fernando Zambrano Gutiérrez. En consecuencia, se ORDENA que en el término improrrogable de veinticuatro (24) horas, contadas a partir de la notificación de esta providencia, se inicie el tratamiento requerido por el actor, sin que para el efecto se le pueda exigir el pago del 60% del valor del medicamento formulado.
Segundo. SEÑALAR que la EPS S.O.S. COMFANDI, puede repetir los sobrecostos en los que incurra como consecuencia del cumplimiento de esta sentencia, en contra del Fondo de Solidaridad y Garantía del Sistema de Seguridad Social Integral en Salud, subcuenta de enfermedades catastróficas o ruinosas.
Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
