- PRIMERO. CONFIRMAR, por las razones expuestas en la parte motiva de esta providencia, el fallo de fecha seis (6) de septiembre de mil novecientos noventa y cinco (1995), proferido por la Corte Suprema de Justicia, Sala de Casación Penal, que revocó el proferido por el Tribunal Superior del Distrito Judicial de Santafé de Bogotá, Sala Penal, el veintiséis (26) de julio del mismo año, en primera instancia.
- SEGUNDO. ORDENAR que por la Secretaría General de esta Corporación, se comunique esta providencia al Tribunal Superior del Distrito Judicial de Santafé de Bogotá, en la forma y para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
