- Primero. REVOCAR la sentencia proferida por el Juzgado
- Segundo. Penal de Bello Antioquia el diez (10) de julio de dos mil uno (2001), y en su lugar, como mecanismo transitorio, CONCEDER el amparo solicitado, en los términos expresados en la parte motiva de esta providencia.
- Segundo. ORDENAR al señor Jhon William Jiménez Tamayo, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, proceda a pagar la licencia de maternidad de la actora, con base en el salario mínimo legal vigente en la época del nacimiento de la criatura.
- Tercero. ADVERTIR a la peticionaria que, en aplicación del artículo 8º del Decreto 2591 de 1991, dentro de los cuatro (4) meses siguientes a esta sentencia instaure ante la jurisdicción ordinaria laboral el respectivo proceso, en orden a obtener el reconocimiento de los pretendidos derechos laborales.
- Cuarto. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
