Primero. REVOCASE el fallo proferido por el Juzgado Ochenta y seis Penal Municipal de Bogota, dentro del proceso de tutela instaurado por la senora Rosa Maria Pineda, en contra de Sanitas EPS por las razones expuestas en la parte motiva de este fallo. En consecuencia, CONCEDASE la proteccion del derecho invocado.
Segundo. ORDENASE a Sanitas EPS, o a quien haga sus veces, si no lo hubiere hecho, que en el termino de cuarenta y ocho (48) horas, contadas a partir de la notificacion de esta providencia, autorice la "Colecistectomia Laparoscopica" a la senora Rosa Maria Pineda.
Tercero. Si a ello hubiere lugar , podra repetirse contra el Fosyga lo que corresponda por la practica de la " Colecistectomia Laparoscopica " a que se ha hecho referencia en el numeral precedente, sobre lo cual habra de resolverse por aquel y efectuarse el pago respectivo en un plazo que no excedera de seis meses.
Cuarto. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
