- Primero. REVOCAR la sentencia proferida por la Sala Civil del Tribunal Superior del Distrito Judicial de Bucaramanga el 24 de mayo de 2001, y en su lugar tutelar los derechos fundamentales de petición y debido proceso de José Rosemberg Upegui Santos.
- Segundo. ORDENAR a Cajanal E.P.S. que dentro de las 48 horas siguientes a la notificación de esta sentencia, efectúe los trámites para notificar la Resolución Nº002614 del 31 de mayo de 2001 al accionante.
- Tercero. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
