Primero. REVOCAR el fallo proferido el nueve (9) de octubre de dos mil dos (2002), por el Juzgado 41 Civil del Circuito de Bogota, dentro de la accion de tutela instaurada por el senor Carlos Alberto Gomez Abril contra el Colegio Cafam de Bogota, por las razones expuestas en la parte motiva de este fallo.
Segundo. En consecuencia, se CONCEDE la accion de tutela para la proteccion del derecho fundamental a la educacion, para lo cual se ORDENA al rector del Colegio Cafam de Bogota, o a quien haga sus veces, que en el termino de cuarenta y ocho horas (48) horas, siguientes a la notificacion del presente fallo, sino lo hubiere hecho, expida los certificados de notas, acta y registro de grado de las alumnas Xiomara Shirley y Evelyn Luisa Gomez Ladino, solicitados por el senor Carlos Alberto Gomez Abril.
Dentro del mismo termino establecido anteriormente, el actor Gomez Abril debera firmar a favor del colegio Cafam, letras de cambio que respalden el monto de la deuda y que haga posible el recibo de los documentos pedidos.
Tercero. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
