Derecho al debido proceso a la administración de justicia a la vivienda digna y respecto por el acto propio de deudor de la entidad creditica a quien le fue liquidado un alivio que con posterioridad la misma entidad unilateralmente modifico las condiciones establecidas en el alivio y reliquido el credito generándose otra obligación para el accionante con nuevos intereses lo que en la actualidad lo tiene en cobro jurídico ante despacho judicial.

Improcedencia de la tutela cuando existen otros medios de defensa judicial.

Teniendo en cuenta que contra el actor se tramita un proceso de carácter civil para obtener el pago de las cuotas atrasadas y dentro del cual se han propuesto excepciones sera en este donde por sentencia judicial se difinira el eventual restablecimiento del derecho al respeto del acto propio y el asentimiento del actor.

Primero. Confirmar las decisiones proferidas por el Juzgado Veintiuno Civil del Circuito el 20 de abril de 2005 y la Sala Civil del Tribunal Superior de Bogotá el 9 de junio de 2005, en la acción de tutela promovida por Adolfo Salazar Bermúdez contra el Banco Granahorrar.
Segundo. Por Secretaria General, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
