PRIMERO. REVOCAR la sentencia proferida por el Juzgado Veintitrés Civil del Circuito de Bogotá, de fecha agosto 02 de 2002. En consecuencia, TUTELAR los derechos a la salud, igualdad, dignidad humana y a la vida del señor Julio César Cabrera Ovalle, por las razones expuestas.
SEGUNDO. ORDENAR a la E.P.S SANITAS que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente providencia, programe y realice las Hemodiálisis y demás tratamientos que pueda requerir la accionante con ocasión de su enfermedad.
TERCERO. SANITAS E.P.S. podrá repetir en contra el Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud y reclamar solamente los sobrecostos que debió asumir con ocasión del mencionado tratamiento.
CUARTO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
