- Primero. CONFIRMAR, por las razones exclusivamente expuestas en esta providencia, los fallos de fecha 4 de abril de 2003, proferido por el Juzgado
- Quinto. Laboral del Circuito de Cartagena, y de fecha 14 de mayo de 2003, por la Sala Laboral del Tribunal Superior de Cartagena, que negaron la tutela de los derechos invocados por el señor Rafael Eduardo Llinás Vargas.
- Segundo. PREVENIR a la Caja Nacional de Previsión Social para que en el futuro se abstenga de incurrir en esta clase de actuaciones que como en el caso concreto vulnera los derechos fundamentales de sus afiliados.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
