- Primero. REVOCAR la Sentencia proferida por la Sala de Casación Civil de la Corte Suprema de Justicia el 9 de noviembre de 1994, mediante la cual se confirmó la del Tribunal Superior del Distrito Judicial de Santa Fe de Bogotá del 23 de septiembre del mismo año, que había negado la tutela impetrada.
- Segundo. Puesto que ha operado la caducidad de los datos financieros negativos respecto del solicitante, JORGE HUMBERTO GUTIERREZ MONTEJO, C. de C. 17.195.223 de Bogotá, ORDENASE a "COMPUTEC S.A.-DIVISION DATACREDITO" que, en un término no superior a las cuarenta y ocho (48) horas contadas a partir de la notificación de esta Sentencia, ELIMINE de manera definitiva y completa cualquier forma de registro de dichos datos negativos en cuanto al peticionario.
- Tercero. Será responsable del cabal y completo cumplimiento de esta providencia el señor GERMAN VILLARREAL SILVA, representante legal de "COMPUTEC S.A.", a quien se le notificará personalmente.
- Cuarto. El desacato a lo ordenado por esta Sentencia se sancionará en la forma prevista por los artículos 52 y 53 del Decreto 2591 de 1991.
- Quinto. LIBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
