  1. Primero. REVOCAR la sentencia de tutela proferida por el Juzgado
  2. Septimo. Laboral del Circuito de Barranquilla, por medio de la cual se nego el amparo solicitado por Hermencia Navarrete de Pavia. En su lugar, CONCEDER la tutela por violacion del derecho fundamental al pago oportuno de la mesada pensional.
  3. Segundo. ORDENAR a la entidad demandada, que dentro del termino de cuarenta y ocho (48) horas siguientes a la notificacion de esta providencia, cancele las mesadas adeudadas a la demandante Hermencia Navarrete de Pavia, siempre y cuando exista partida presupuestal disponible. En caso de que no exista la respectiva partida, debera realizar las operaciones presupuestales para garantizar el pago de las mesadas adeudadas. Dichas gestiones no podran exceder el termino perentorio de tres (3) meses.
  4. Tercero. PREVENIR a la entidad demandada para que cumpla lo dispuesto en este fallo, so pena de incurrir en desacato, y para que en lo sucesivo no repita la omision que dio origen a la presente accion.
  5. Cuarto. Por Secretaria librese la comunicacion de que trata el articulo 36 del Decreto 2591 de 1991.
