- PRIMERO. CONFIRMAR la sentencia proferida por el Juzgado Unico Civil del Circuito de Cienaga (Magdalena), por las razones expuestas en esta sentencia.
- SEGUNDO. ORDENAR al Juez Unico Civil del Circuito de Cienaga (Magdalena), que COMPLEMENTE la sentencia revisada, asi:
- a) Ordenar al peticionario de la tutela senor Olimpo Fragoso Diaz que restituya en favor de Carbones de Colombia CARBOCOL S. A. e International Resources Corporation INTERCOR, la suma de noventa y cuatro millones, trescientos sesenta y un mil novecientos veintidos pesos con cincuenta centavos ($94.361922.50), por las razones expuestas en esta sentencia;
- b) Incluir la condena en costas conforme a lo dispuesto en el articulo 25 del Decreto 2591 de 1991; y,
- c) Incluir que la sentencia presta merito ejecutivo en los terminos del articulo 488 del Codigo de procedimiento Civil.
- TERCERO. ENVIAR copia de esta sentencia a la Fiscalia General de la Nacion, a la Procuraduria Delegada para la Vigilancia Judicial y al Consejo Superior de la Judicatura, para lo de su competencia.
- CUARTO. COMUNICAR el contenido de la sentencia al Juzgado Promiscuo Municipal de Sitionuevo (Magdalena), al Juzgado Unico Civil del Circuito de Cienaga (Magdalena), a los Representantes Legales de CARBOCOL S.A., e INTERCOR, a la apoderada del senor Felix Fabian Fragoso Fonseca, al Defensor del Pueblo y al peticionario de la tutela.
