PRIMERO. REVOCAR las decisiones de la Seccion Segunda, Subseccion A del Tribunal Administrativo de Cundinamarca y de la Seccion Segunda, Subseccion A, de la Sala Contenciosa Administrativa del Consejo de Estado, por las razones expuestas en las consideraciones de esta Sentencia. En su lugar, CONCEDER la accion de tutela impetrada en los terminos expresados en la parte motiva.
SEGUNDO. ORDENAR al Fondo Nacional de Prestaciones Sociales del Magisterio y el Fondo Educativo Regional de Cundinamarca aplicar las normas contenidas en los articulos 1deg y 2deg de la Ley 33 de 1973 y en los articulos 46, 47 y 48 de la Ley 100 de 1993 y, en consecuencia, pagar a la actora las mesadas pensionales a las que tiene derecho conforma a dichas normas.
TERCERO. ADVERTIR a la accionante que los efectos de la presente Sentencia son transitorios por el termino de cuatro (4) meses a partir de su notificacion, termino en el cual debera acudir a la jurisdiccion contenciosa administrativa para iniciar el tramite correspondiente tendiente a definir la legalidad de las Resoluciones 856 de 1996 y 1254 de 2000 y la existencia de su derecho de continuar recibiendo la pension que reclama.
CUARTO. LIBRESE por la Secretaria General de esta Corporacion, la comunicacion de que trata el articulo 36 del decreto 2591 de 1991.
