- Primero. REVOCAR los fallos proferidos por el Juzgado
- Segundo. Laboral del Circuito y la Sala Laboral del Tribunal Superior del Distrito Judicial de Santa Marta, mediante los cuales se negó el amparo solicitado por Gina Adarraga Gómez.
- En su lugar, se CONCEDE la tutela en forma transitoria, de los derechos a la igualdad, a la estabilidad laboral y al mínimo vital de la demandante y su hijo.
- En consecuencia, se ORDENA a "Eficacia S.A." reintegrar, en forma inmediata, a la peticionaria al cargo que venía desempeñando al momento del despido, o a uno similar o superior, sin que le sea posible desmejorar las condiciones laborales de la empleada. Esta orden tendrá vigencia hasta tanto se decida en forma definitiva el proceso laboral ordinario que promovió la trabajadora.
- Lo ordenado debe cumplirse -so pena de la aplicación de las sanciones previstas en el artículo 52 del Decreto 2591 de 1991- dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este Fallo.
- Lo anterior, sin perjuicio de la indemnización a que tiene derecho la trabajadora, que deberá cancelarse en el mismo término.
- Segundo. SE NIEGA la tutela en cuanto corresponde a la sociedad "Colgate Palmolive Compañía".
- Tercero. DAR cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
