Demanda de inconstitucionalidad contra el artículo 29 de la Ley 1617 de 2013, por la cual se expide el Régimen para los Distritos Especiales.
Aduce el actor que la norma acusada, en cuanto regula la modalidad de control político de los Concejos Distritales consistente en proponer “moción de observaciones” respecto de los actos de los funcionarios sobre quienes ejerce control, no respeta el principio constitucional del artículo 4º Superior, según el cual la norma constitucional es norma de normas.
La Corte no encuentra suficiencia en el cargo presentado por el demandante a la disposición normativa y por ello, decide declararse INHIBIDA para resolver el fondo de la petición de inconstitucionalidad, por ineptitud sustantiva de la demanda.
