Demanda de inconstitucionalidad contra el artículo 49 (parcial) de la Ley 200 de 1995, “por la cual se expide el Código Disciplinario Único”.
El actor consideró que el término “control interno” se le otorgó un significado distinto al establecido al artículo 209 de la Constitución.
Así mismo, afirmó que el legislador confunde conceptos distintos - control disciplinario y control interno -, y trastoca el sentido de las funciones disciplinarias violando los artículos 118 y 277 de la Constitución.
La Sala Plena concluyó que la norma no confunde el control interno de índole administrativo con el de carácter disciplinario, siendo un cargo sustentado desde la interpretación subjetiva del demandante.
La Corte se declaró inhibida de resolver.
