Revisión de constitucionalidad del “Acuerdo de diálogo político y cooperación entre la Comunidad Europea y sus Estados miembros, por una parte, y la Comunidad Andina y sus países miembros (Bolivia, Colombia, Perú, Ecuador y Venezuela), por otra parte hecho en Roma, el 15 de Diciembre de 2003 y la Ley 1349 de 2009 que lo aprueba”.
La Corte se pronuncia sobre la competencia y el objeto de control, pasa a realizar un estudio formal sobre la descripción y el trámite que se surtió sobre la ley aprobatoria del tratado, luego se realiza un análisis sobre el contenido, el contexto normativo y constitucional del acuerdo de diálogo político, se encuentra que la norma es acorde con los preceptos constitucionales se decide declarar la exequibilidad del acuerdo y de su ley aprobatoria.
