en nombre del pueblo y por mandato de la Constitución,
R E S U E L V E :
PRIMERO. Declarar EXEQUIBLE la expresión "calificar" contenida en el numeral
primero. del artículo 17 de la Ley 81 de 1993.
SEGUNDO. Declarar INEXEQUIBLE la expresión "o por conducto de sus delegados de la unidad de fiscalía ante la Corte Suprema de Justicia" contenida en el numeral
primero. del artículo 17 de la Ley 81 de 1993. No obstante, se advierte que el fiscal general de la Nación podrá comisionar a los fiscales delegados ante la Corte Suprema de Justicia para la práctica de todas las actuaciones procesales distintas a la calificación y a las subsecuentes de formular acusación o abstenerse de hacerlo.
TERCERO. ABSTENERSE de emitir pronunciamiento alguno acerca de la competencia de las autoridades para juzgar a los funcionarios públicos enumerados por el actor, de conformidad con las razones expuestas en esta providencia.
