  1. PRIMERO. REVOCAR la sentencia proferida por el Juzgado Treinta y Tres Penal del Circuito de Bogotá, el 16 de junio de 2005, dentro de la acción de tutela de la referencia, y, en consecuencia, CONCEDER la acción de tutela para proteger el derecho fundamental de petición para el reconocimiento y pago de la pensión de la señora Liriam de Jesús Guerra Gallego.
  2. SEGUNDO. ORDENAR a la Caja Nacional de Previsión Social, Seccional Bogotá, que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de la presente Sentencia, si todavía no lo ha hecho, dé respuesta de fondo a la solicitud de pensión de la señora Liriam de Jesús Guerra Gallego, radicada el 26 de enero 2005.
  3. TERCERO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
