- Primero. REVOCAR la sentencia de la Sala de Casación Laboral de la Corte Suprema de Justicia y en su lugar, CONFIRMAR la decisión de la Sala Laboral del Tribunal Superior de Cartagena, que concedió la tutela a los derechos a la salud y a la vida de la demandante y de sus hijos.
- Segundo. PREVENIR al Gobernador de Bolívar con el fin de que tome las medidas encaminadas a ponerse al día en el pago de las cotizaciones por salud, y no vuelva a incurrir en las omisiones ilegítimas que dieron origen a esta acción, so pena de las sanciones legales correspondientes.
- Tercero. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1.991.
