Primero. CONFIRMAR, pero por las razones expuestas, el fallo proferido por el Juzgado 44 Civil Municipal de Bogota, en cuanto nego la accion de tutela incoada por Jose Antonio Sepulveda Cristancho.
Segundo. REVOCAR el fallo proferido por el Juzgado 1 Penal Municipal de Itagui y, en su lugar, CONCEDER la tutela interpuesta por Edilma del Socorro Espinosa Saldarriaga.
Tercero. ORDENAR a Computec S.A., Division Datacredito que, en el termino de cuarenta y ocho (48) horas, contado a partir de la notificacion de esta Sentencia, proceda a eliminar de su banco de datos cualquier registro que posea respecto de la senora Edilma del Socorro Espinosa Saldarriaga, con C.C. 32"342.011 de Itagui.
Cuarto. Por Secretaria, Remitase copia de esta providencia al Presidente del Banco de Occidente de acuerdo con lo manifestado en la parte considerativa.
Quinto. Por Secretaria, LIBRESE la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991, para los fines alli contemplados.
