Primero. REVOCAR el fallo de fecha 26 de mayo de 2003, proferido por el Juzgado
Tercero. Penal del Circuito de Montería (Córdoba) que negó el amparo de los derechos invocados en el asunto de la referencia.
Segundo. CONCEDER la protección de los derechos fundamentales a la salud en conexidad con la vida digna y la seguridad social de la señora Olga Cecilia Pérez Gutiérrez.
Tercero. ORDENAR a la ARS COMPARTA que dentro de las 48 horas siguientes a la notificación de este fallo, si aún no lo ha hecho, suministre las pipetas de oxígeno ordenadas por el médico tratante y que se requieren para la recuperación de la salud de la señora Olga Cecilia Pérez Gutiérrez. Se advierte a la ARS COMPARTA que podrá repetir contra el Fondo de Solidaridad y Garantía (FOSYGA) por los gastos en que incurra en el cumplimiento de lo ordenado en esta providencia y que no estén cubierto por el POS- S.
Cuarto. Por Secretaría líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
