- Primero. REVOCAR el fallo proferido por el Juzgado 36 Civil Municipal de Bogotá, D.C., que denegó el amparo deprecado por el Personero de Bogotá, D.C, en nombre de Alicia Cadena Badillo y, en su lugar, CONCEDER la tutela incoada.
- Segundo. ORDENAR a la Secretaría Distrital de Salud de Bogotá que, en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta Sentencia, adelante las gestiones necesarias para que a la señora Alicia Cadena Badillo se le practique el examen de Doppler Duplex venoso de miembros inferiores, para lo cual deberá coordinar con las instituciones prestadoras de salud adscritas o con las que tenga contrato. Lo anterior, sin perjuicio del derecho que le asiste para repetir contra el Fondo de Solidaridad y Garantía, Fosyga.
- Tercero. Por Secretaría, LÍBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991, para los fines allí contemplados.
