- Primero. REVOCAR la sentencia de primera instancia proferida por el Juzgado Veinte Civil del Circuito de Santafe de Bogota el 13 de mayo de 1996, y la proferida en segunda instancia por el Tribunal Superior del Distrito Judicial de Santafe de Bogota, Sala Laboral, con fecha 30 de julio del mismo ano.
- Segundo. CONCEDER, por las razones expuestas en la parte motiva de esta providencia, la tutela de los derechos constitucionales fundamentales a la libertad, a la igualdad y al trabajo en condiciones justas, vulnerados a MARIA LUISA CASTRO DE URQUIJO. En consecuencia, SE ORDENA a la empresa ALMACENES LOS TRES ELEFANTES S.A. que dentro de las 48 horas siguientes a la notificacion de esta sentencia proceda a reconocer y pagar la diferencia salarial que corresponda a la peticionaria de la tutela, tomando como punto de referencia las mismas condiciones de trabajo establecidas en favor de las trabajadoras que laboran como Cajeras 2 y que optaron por el regimen de cesantias previsto en la Ley 50 de 1990, sin que, para tal efecto, le sea exigido acogerse a dicho regimen.
- Tercero. CONMINAR a la Empresa Almacenes Los Tres Elefantes S.A., para que en lo sucesivo se abstenga de realizar conductas discriminatorias frente a sus empleados que vulneren los derechos a la libertad, a la igualdad y al trabajo.
- Cuarto. LIBRENSE, por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
