Primero. CONFIRMAR la sentencia de la Sala de Casacion Civil y Agraria de la Corte Suprema de Justicia del 17 de mayo de 1997, proferida dentro del presente proceso, con la modificacion que se consigna en el ordinal siguiente.
Segundo. CONDENAR a los senores Fernando Brochero Pineda y Ovidio Gonzalez Bonilla al pago de las costas que se hubieran ocasionado en el tramite del presente proceso, por darse la circunstancia prevista en el articulo 25 del Decreto 2591 de 1991. Procedera a liquidarlas el Tribunal Superior de Distrito Judicial de Cali, teniendo como unico factor para valorar la TEMERIDAD, la ponderacion entre los limites que establece el articulo 73 del C. de P.C. (Diez a veinte salarios minimos mensuales). Cifra que una vez tasada y cuando haya quedado en firme se consignara a nombre del Consejo Superior de la Judicatura en la oficina y en la cuenta respectiva.
Tercero. REMITIR copia de esta providencia al Consejo Superior de la Judicatura para lo que estime pertinente.
Cuarto. COMUNIQUESE lo resuelto en esta providencia al Tribunal Superior de Cali para las notificaciones y efectos previstos en el articulo 36 del Decreto 2591 de 1991.
