- Primero. Confirmar, aunque por razones distintas, la sentencia del 28 de noviembre de 2000 proferida por el Juzgado 18 Penal Municipal de Cali, por la cual se accedió a la demanda de tutela instaurada por Alma Nury Martínez García contra Edison García Camayo.
- Segundo. La protección que aquí se concede es a título de mecanismo transitorio. Vale decir, esta providencia permanecerá vigente sólo durante el término que la autoridad judicial competente utilice para decidir de fondo sobre la acción instaurada por la afectada al tenor de la ley 294 de 1996 y del artículo 8 del decreto 2591 de 1991. En todo caso, la peticionaria deberá ejercer dicha acción en un término máximo de 4 meses, contados a partir de la notificación de este fallo, so pena de que sus efectos cesen al precluir el mismo.
- Tercero. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
