PRIMERO. REVOCAR, por las razones aquí expuestas, la sentencia proferida el 18 de diciembre de 2002 por el Juzgado Veintidós Civil del Circuito de Bogotá.
SEGUNDO. En su lugar, CONCEDER la tutela al señor Hugo Galvis Pinzón por violación al debido proceso, y por lo tanto declarar que el accionante no está obligado a pagar la sanción multa de cincuenta (50) salarios mínimos legales mensuales vigentes, contenida en el numeral
segundo. de la Resolución del Consejo de Justicia proferida el 10 de diciembre de 1998, por las razones expuestas en la parte motiva.
TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
