  1. PRIMERO. MODIFICAR el fallo proferido por el Juzgado Veinte Civil del Circuito de Bogotá, el veintiuno (21) de enero de 2003, por las razones expuestas en la parte motiva de esta sentencia, y por tanto tutelar no sólo el derecho de petición, sino también el derecho a que se decida mediante resolución lo que corresponda según la ley acerca de la pensión de vejez del accionante, señor Eladio Mosquera Borja.
  2. SEGUNDO. En consecuencia, ORDENAR al Fondo de Previsión Social del Congreso de la República que en el término de cuarenta y ocho (48) horas contadas a partir de la comunicación de la presente sentencia, profiera la Resolución de fondo sobre pensión del señor Eladio Mosquera Borja.
  3. TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
