- Primero. REVOCAR la sentencia proferida por la Sala Laboral del Tribunal Superior de Tunja el día tres (3) de mayo de 2002. En su lugar CONCEDER la tutela por violación del derecho a la igualdad.
- Segundo. ORDENAR al Alcalde Municipal de Siachoque (Boyacá), para que en el término de sesenta (60) días contados a partir de la notificación de esta sentencia, culmine los trámites necesarios para lograr la afiliación de la señora Nohora Graciela Garavito Vargas al Fondo Nacional de Prestaciones Sociales del Magisterio, atendiendo las normas vigentes sobre la materia y las regulaciones que de la ley 715 de 2001 se hagan al respecto.
- Tercero. Por Secretaría General, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
