Primero. REVOCAR el fallo proferido por el Juzgado
Primero. Penal del Circuito de San Juan de Pasto del 22 de enero de 1999. En su lugar TUTELAR los derechos fundamentales al trabajo y al pago oportuno del salario a los demandantes representados por el señor Francisco Javier Patiño Mora, contenidos en la lista obrante a folios 55 a 62 del expediente.
Segundo. ORDENAR al señor Gobernador de Nariño, que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación del presente fallo, proceda, si aún no lo ha hecho, a cancelar los salarios debidos a los actores contenidos en la lista a que se refiere el numeral anterior, siempre y cuando exista la debida partida presupuestal. En caso contrario, dentro del mismo término deberá iniciar las gestiones pertinentes que le permitan atender con el pago ordenado.
Tercero. LÍBRENSE por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
