- Primero. REVOCASE la sentencia de primera instancia en la acción de tutela de la referencia y en su lugar se concede la tutela como protección a la estudiante DANIELA BERRIO TAVERA en su derecho a la educación.
- En consecuencia se ORDENA:
- a) En el término de ley, el [CC1]Alcalde Mayor del Distrito de Santa Marta y el Gobernador del departamento del Magdalena darán curso a todas las actuaciones para el cumplimiento de lo señalado en la Ley 60 de 1993 en lo referente al Colegio Francisco de Paula Santander de Santa Marta. Cada quince días rendirán informe escrito al Juez de tutela (
- Octavo. Penal Municipal de Santa Marta), con copia a la asociación de padres de familia de dicho colegio y a la Defensoría del Pueblo.
- b) Mientras se cumple con la anterior tramitación, el Distrito de Santa Marta, sostendrá el personal necesario para el funcionamiento del colegio y destinarán una suma de dinero para las urgentes reformas locativas.
- c) El Rector del colegio vigilará el cumplimiento de las horas de trabajo del personal administrativo.
- Segundo. Para los efectos del artículo 36 del Derecho 2591 de 1991, el Juzgado de origen hará las notificaciones y tomará las medidas adecuadas para el cumplimiento del presente fallo.
