- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E:
- PRIMERO. REVOCAR la sentencia del 24 de mayo de 1994, proferida por el Juzgado Setenta y Nueve Penal Municipal de Santafé de Bogotá, mediante la cual se negó la tutela solicitada por el señor Pedro Orlando Ubaque, por las razones expresadas en el presente fallo.
- SEGUNDO. CONCEDER al señor Pedro Orlando Ubaque la tutela de sus derechos fundamentales a la vida y a la salud.
- TERCERO. ORDENAR al señor Director de la Cárcel Nacional Modelo que en el término de tres meses contados a partir de la notificación de la presente decisión proceda a realizar y a concluir las obras de adecuación proyectadas en el pabellón No. 3 de dicha cárcel.
- Se deja al criterio razonable del Señor Director determinar si efectúa el traslado del interno peticionario de la tutela a otro lugar que ofrezca mejores condiciones, como el pasillo del patio
- séptimo. que sugiere su solicitud.
- CUARTO. COMUNICAR al Juzgado Setenta y Nueve Penal Municipal de Santafé de Bogotá, la presente decisión para que sea notificada a las partes, conforme lo ordena el artículo 36 del decreto 2591 de 1991.
