- Primero. REVOCAR parcialmente el fallo proferido el cinco (5) de agosto de mil novecientos noventa y cuatro (1994) por el Juzgado
- Sexto. Laboral del Circuito de Santa Fe de Bogotá, D.C., mediante el cual se resolvió acerca de la acción instaurada por AQUILINO FLORIAN DIAZ y TERESA DE JESUS LARRARTE DE MARTINEZ.
- Segundo. DENEGAR la tutela impetrada por TERESA DE JESUS LARRARTE DE MARTINEZ, por carencia actual de objeto, toda vez que la petición por ella formulada fue resuelta el ocho (8) de agosto del presente año.
- Tercero. TUTELAR el derecho de petición de AQUILINO FLORIAN DIAZ y, en consecuencia, ordenar al Director de la CAJA NACIONAL DE PREVISION SOCIAL que, en un término máximo de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta sentencia, RESUELVA, si todavía no lo ha hecho, sobre la solicitud formulada ante dicho organismo, relacionada con el reconocimiento de la pensión gracia.
- Cuarto. REMITASE copia del expediente y de esta sentencia al Procurador General de la Nación para que se investigue acerca de la conducta omisiva de los servidores de la CAJA NACIONAL DE PREVISION SOCIAL.
