- Primero. REVOCAR la sentencia proferida por la Sección Segunda del Consejo de Estado el 14 de octubre de 1999 y, en su lugar, tutelar el derecho al debido proceso de Carbones del Caribe S.A. como mecanismo transitorio para evitar un perjuicio irremediable, mientras la jurisdicción contencioso administrativa se pronuncia sobre la acción de nulidad y restablecimiento del derecho incoada, y resuelve sobre las excepciones propuestas.
- Segundo. REMITIR copia de esta providencia a la Procuraduría General de la Nación para lo de su competencia.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
