Primero. REVOCAR la sentencia expedida por la Sala Civil Laboral del Tribunal Superior de Popayán el 1 de febrero de 1999 (expediente T-202570) y la dictada por el Juzgado 1 Penal del Circuito de Popayán el 15 de diciembre de 1998 (expediente T-203039).
Segundo. CONFIRMAR la sentencia expedida por la Sala Laboral del Tribunal Superior de Popayán el 28 de enero de 1999 (expediente T-202590), pero única y exclusivamente por las razones anotadas en la parte motiva de esta providencia.
Tercero. LÍBRESE por la Secretaría General de esta Corporación, la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
