PRIMERO. Revocar la sentencia proferida por el Juzgado
Sexto. Civil del Circuito de Bogotá, el diecisiete de enero de 1992, por la cual se negó la tutela formulada por Mauricio Nicolás Sánchez Molano y Fabio Aníbal Rojas Isaza.
SEGUNDO. Declarar la inaplicación, por inconstitucional, del artículo
cuarto. del acuerdo 26 de 1986, emanado del Concejo Municipal de Chía, y de los artículos
primero. y
segundo. del decreto numero 46 de 1991, emanados de la Alcaldía Especial de Chía.
TERCERO. Conceder la tutela formulada por Mauricio Nicolás Sánchez Molano y Fabio Rojas Isaza contra las resolución 81-91 de Octubre 31 de 1991, emanada de la Inspección Municipal de Policía y Tránsito de Chía, por la cual se sancionó a los peticionarios de esta tutela.
CUARTO. En consecuencia, ORDENAR que cese la aplicación de dicha resolución, y por tanto, que se restituya a los peticionarios las máquinas de video juego.
QUINTO. ORDENAR que por secretaría se comuníque esta decisión al Juez
sexto. Civil del Circuito de Santafé de Bogotá, en la forma señalada en el artículo 36 del Decreto 2591 y para los efectos allí previstos.
