en nombre del pueblo y por mandato de la Constitución,
R E S U E L V E :
Primero. MODIFICAR el numeral
Primero. de la sentencia proferida por el Juzgado
Segundo. Penal del Circuito de Melgar, de enero 24 de 1992, para resolver las peticiones de la demanda de la referencia, en los siguientes términos:
DENEGAR las peticiones del actor LUIS HERNANDO HEREDIA LEON, por no haberse violado el derecho al debido proceso, ni estar en juego en este caso el Derecho a la Vivienda, que, por otra parte no tiene la categoría de derecho fundamental.
Segundo. CONFIRMAR los numerales segundo,
tercero. y cuarto, de la sentencia del Juez
Segundo. Penal del Circuito de Melgar de enero 24 de 1992, mediante la cual se resolvió la acción de tutela promovida por el señor LUIS HERNANDO HEREDIA LEON.
Tercero. Comuníquese al Juzgado
Segundo. Penal del Circuito de Melgar, la presente decisión para que sea notificada a las partes conforme a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
