- Primero. CONFIRMAR el fallo del Tribunal Superior del Distrito Judicial de Ibagué del veinticinco (25) de mayo de mil novecientos noventa y cuatro (1994), mediante el cual se revocó la providencia de primera instancia.
- Segundo. ORDENAR que se oficie al Ministerio del Medio Ambiente para que, dentro de la órbita de sus atribuciones y en cumplimiento de la función primordial que le compete, adelante en el Departamento del Tolima las investigaciones indispensables, a fin de establecer si la fumigación aérea está causando o puede causar contaminación y, de ser así, para que adopte las medidas pertinentes, de carácter preventivo o sancionatorio, en forma directa o en coordinación con otras agencias estatales.
- Tercero. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
