Petición, mínimo vital.
La accionante solicita se ordene a la entidad accionada, que proceda a darle respuesta de fondo al derecho de petición presentado por ella solicitando se haga efectiva la póliza por muerte en accidente de tránsito de su cónyuge.
La Sala pasa a estudiar el seguro obligatorio de accidentes de transito y realiza reiteración de jurisprudencia en cuanto a la subsidiariedad de la acción de tutela, se concluye que los derechos de la accionante no fueron vulnerados ya que se le dio respuesta a su derecho de petición indicándole los trámites que debía seguir para obtener el pago de la póliza, el cual se debe adelantar mediante otro mecanismo de defensa judicial, por lo tanto se decide negar la protección de los derechos invocados.
