- PRIMERO. CONFIRMAR el numeral 1º de la sentencia que se revisa, proferida por el Juzgado
- Tercero. Penal del Circuito de Santander de Quilichao, pero por las razones expuestas en el presente fallo.
- SEGUNDO. REVOCAR el numeral 2º de dicho fallo.
- TERCERO. Remitir copia de esta sentencia a la Superintendencia de Salud para que, si lo estime pertinente, se investigue al Hospital Francisco de Paula Santander de Santander de Quilichao por la mora en los aportes al I.S.S..
- CUARTO. Para efectos del art. 36 del Decreto 2591 de 1991, se oficiará al Juez de Primera instancia.
