- Primero. CONFIRMAR al sentencia del quince (15) de marzo de mil novecientos noventa y seis (1996), proferida por el Juzgado 35 Penal Municipal de Cali. En consecuencia, negar la tutela solicitada por el señor Freddy Rivera.
- Segundo. CONDENAR en costas al demandante Freddy Rivera. El Juzgado 35 Penal Municipal de Cali, una vez ejecutoriada esta sentencia, iniciará el procedimiento respectivo, para la liquidación y pago de las costas a cargo del demandante, de conformidad con las razones expresadas en esta sentencia.
- Tercero. COMUNICAR esta decisión al Juzgado 35 Penal Municipal de Cali, para que sean notificadas las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991.
