Derecho a la vida la salud y la seguridad social de persona que padece ulcera en el ojo izquierdo y fuerte dolor por no haber sido atendido por la secretaria de salud por cuanto se encuentra en un nivel de sisben 3 y en la isla la eps a la que se encuentra afiliado no tiene cobertura presentando una doble afiliación al sistema general de seguridad social en salud.
Solicita se ordene el suministro de la atención medica que requiere.
Derecho a la salud y su proteccion constitucional mediante la afiliación al sistema general de seguridad social.
En el asunto se dan lo presupuestos para que opere la cancelación de la afiliacion múltiple.

- Primero. CONFIRMAR la sentencia proferida el 31 de mayo de 2004 por el Tribunal Superior del Distrito Judicial del Archipiélago de San Andrés, Providencia y Santa Catalina, que denegó la acción de tutela interpuesta por el señor Francisco Javier Sánchez Gómez.
- Segundo. ORDENAR a la Secretaría de Salud municipal de San Andrés, que inicie, con observancia del debido proceso, la actuación administrativa tendiente a dejar sin efecto la selección que en favor del señor Francisco Javier Sánchez Gómez se hiciera como beneficiario del régimen subsidiado de salud.
- Tercero. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
