- Primero. REVÓCASE la sentencia proferida por la Sala Laboral del Tribunal Superior de Barranquilla que revocó el fallo del Juzgado 1 Laboral del Circuito de Barranquilla, en la acción de tutela instaurada por la señorita Kelly María Gutiérrez Vivius, en contra del Seguro Social -Seccional Barranquilla-.
- En consecuencia, ORDÉNASE al Seguro Social -Seccional Barranquilla-, que en el término de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, reanude el pago de las mesadas correspondientes a la pensión de sobrevivientes que le fueron reconocidas a la señorita Kelly María Gutiérrez Vivius, hasta que cumpla los 25 años de edad, siempre que continúe estudiando, circunstancia que deberá acreditar periódicamente, de conformidad con el artículo 47 de la Ley 100 de 1993. El Seguro Social pagará a la actora las mesadas dejadas de cancelar desde el momento en que los pagos fueron interrumpidos, sumas que deberán ser indexadas.
