Primero. REVOCAR la sentencia proferida por el Tribunal Superior del Distrito Judicial de Cartagena -Sala Penal- el veintisiete (27) de noviembre de mil novecientos noventa y ocho (1998). En su lugar CONFIRMAR la providencia del Juzgado único Penal del Circuito de Mompós, del veintiocho (28) de octubre de la misma anualidad, mediante la cual se concedió el amparo de los derechos fundamentales al trabajo y a la seguridad social de los señores Manuel Salvador Rodríguez y Manuel Francisco García Guerra y se ordenó el pago de los salarios atrasados. La orden de pago deberá cumplirse por el Alcalde Cicuco siempre y cuando exista la partida presupuestal correspondiente. Si esta fuere insuficiente, dispondrá del término ya señalado para iniciar las gestiones tendientes a obtener los recursos necesarios para el pago efectivo y completo de lo ordenado.
Segundo. LÍBRENSE las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
