- PRIMERO. REVOCAR la Sentencia proferida por el Juzgado 2o Promiscuo Territorial de Saravena -Arauca-, teniendo en cuenta los considerandos de este fallo.
- SEGUNDO. En consecuencia, DENEGAR la accion de tutela interpuesta por Luz Marina Henao Lopera contra el Juzgado 124 de Instruccion Penal Militar, el Ministerio de Defensa Nacional y el Grupo Mecanizado de Caballeria No. 19 del Ejercito Nacional, por las razones expuestas en esta sentencia.
- TERCERO. COMUNICAR a traves de la Secretaria General de la Corte Constitucional el contenido de la sentencia al Juzgado 2o Promiscuo Territorial de Saravena -Arauca-, al Juzgado 124 de Instruccion Penal Militar, al Ministerio de Defensa Nacional, al Grupo Mecanizado de Caballeria No. 19 del Ejercito Nacional, al Defensor del Pueblo y a la peticionaria de la presente tutela.
